Terms of Service

1. Acceptance of Terms

By accessing or using Hoply (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Hoply is a unified time tracking and calendar application that integrates with Harvest, Google Calendar, and Jira. The Service provides:

  • Unified calendar view across connected services
  • Time entry creation and management
  • Jira issue linking and worklog creation
  • AI-powered insights and suggestions

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to use the Service
  • One person or legal entity may not maintain more than one free account

4. Free and Paid Plans

4.1 Free Plan

  • Includes core features with limitations as described on our pricing page
  • Limited to 1 service connection
  • AI assistant limited to 5 messages per day
  • We reserve the right to modify free plan features with 30 days notice

4.2 Pro Plan

  • Billed monthly at the rate specified on our pricing page
  • Includes all features without limitations
  • Payment is processed through our payment provider
  • You may cancel at any time; service continues until end of billing period

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated tools to access the Service without permission
  • Share your account credentials with others
  • Resell or redistribute the Service

6. Third-Party Integrations

  • The Service connects to third-party services (Harvest, Google Calendar, Jira) via OAuth
  • Your use of these services is governed by their respective terms of service
  • We are not responsible for the availability or functionality of third-party services
  • You may revoke access to connected services at any time through your account settings

7. Intellectual Property

  • The Service, including its design, code, and content, is owned by Hoply
  • You retain all rights to your data and content
  • By using the Service, you grant us a limited license to process your data as needed to provide the Service

8. AI Features

  • AI features use third-party AI models to provide insights and suggestions
  • AI responses are provided “as is” and should not be relied upon as professional advice
  • We do not guarantee the accuracy of AI-generated content
  • AI conversations may be used to improve the Service (in anonymized form)

9. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated in advance when possible
  • We are not liable for downtime caused by third-party service outages

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein.

11. Termination

  • You may terminate your account at any time through account settings
  • We may suspend or terminate your account for violation of these terms
  • Upon termination, your data will be retained for 30 days then permanently deleted
  • You may request immediate data deletion by contacting support

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided “AS IS” without warranties of any kind
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • We are not liable for data loss resulting from third-party service failures

13. Indemnification

You agree to indemnify and hold harmless Hoply from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

14. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

15. Governing Law

These terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
